In order to ride a moped legally in Florida, you’ll need to be sure to follow the rules and regulations. Failing to do so could result in traffic tickets, fines, or a suspended license.
In Florida, a moped is defined as having:
- No more than 3 wheels.
- Pedals for human power.
- An engine of no more than 50cc.
- An automatic transmission.
- A top speed of no more than 30 mph.
- A motor rated no more than 2 brake hp.

In Florida, you will generally need a standard driver’s license to legally ride a moped on public roads.
How to Get a Florida Moped License
Since Florida requires a driver’s license to ride a moped, you’ll usually need to:
- Visit the HSMV office.
- Complete an application and submit proof of ID.
- Pass the vision test.
- Pass the written knowledge exam.
- Pass a road test.
- Pay the driver’s license fees.
